Various jurisdictions in the United States clearly mentioned that the fundamental right of the parents exists in their care, custody and control of their children. Any state laws cannot impose the orders on parental objection. And hence many grandparents and parents enter into an out of court settlement for these kinds of issues. Grandparents visitation involves a shift in the concentration of the children’s emotions.  It is good in that helps in deflecting the tension and distracts the children’s minds from the memories of their parents’ situation or their fears rejection by their parents or peers because of their emotional states. It is possible that divorce or substance abuse on part of one or both of the parents scars the children in unexpected ways such as the children themselves turning to abuse or inferiority complexes or emotional insecurity.

In every state or country grandparents have rights towards their grandchildren.  In some situation custody of their grandchildren or court mediated visitation with their grandchildren are sometimes enforced. In common law there is no provision for such rights. But in recent times state legislation did some recognition about the grandparents rights.

Have we ever realized that spending few hours with the grandparent does bring a lot of positive change in a child’s behavior? The very subject of grandparents rights is a complicated one. Emotionally grandparents and grand kids both have all the rights over each other but legally? Unfortunately it is quite different as the law of state has drawn a line. In this respect, there is no common law in The United State of America and every state has its own law.

 One who wants to have his rights over his grand children must understand the prevailing law of his state. Only the mothers and fathers have the natural rights over their children and the same way only direct children have the right over their fathers and mothers.

Separations and divorces and some time untimely deaths of mother or father or both make the question of grandparents rights complicated.

In case of separation or divorce normally the father or mother is granted the right over the children and in case of demise of one of the parent the natural right is granted to the surviving parent. In all these situations the willing grandparents will have to challenge the court of law. They will have to prove that the custodian of the child is not capable to look after the child on the ground of his/her financial or physical conditions or because of his/her character. They even need to prove their closeness and emotional bonding with their grandchild and convince the court that they are the best well-wisher and financially capable to look after the future of the children.
